A California appellate court recently confirmed that employees need not exhaust administrative remedies before pursuing most state Labor Code claims, even those accruing prior to the enactment of Labor Code Section 244(a), which expressly states there is no administrative exhaustion requirement. The decision brings clarity to an area of law noted for its split of authority.

A brick tossed through the window with the note “I quit” sent a pretty clear message.

So did the sugar-coated message from another employee—a cake with a resignation letter written in icing on top.

Then there was the worker who couldn’t be bothered with composing an entire letter and left a sticky note to announce he was quitting.

The “Nine to Five” has long ago been replaced by the “Eight to Six” and the “Seven to Nine”. Technology is making it easier for us to worker longer hours, both in the office and at home (or on vacation too), but are we getting more done? Is this work providing us with a better life? We are being psychologically pushed towards working increasingly longer days and weeks while the mounting body of evidence is telling us to do the opposite.

In this electronically connected workforce, telecommuting or working from home is easier than ever. Research shows that employees who work from home tend to be more productive then when in the office, but setting up a telecommuting policy may not be as easy as it sounds. There are certain legal implications that employers should consider when allowing employees to work from home.

In the same way that many believe that people are intrinsically good, I believe that people intrinsically want to succeed. There are always exceptions to the rule but keeping this at the front of my mind has helped me a ton in my HR career. Most employees want to come to work and do their best, even when it looks like they are floundering. One way we can help them do this is by creating a performance improvement plan to help them along the way.

The world has transformed since the turn of the twenty-first century, yet why are we recruiting the same way we did in the 90s?

Fifteen years ago, I co-founded my first staffing company. We filled jobs by running ads on job boards and by matching up resumes based on keywords. As I look around at the hiring strategies of companies today, not much has changed.

Talent pools are something we all should be well aware of as HR Leaders. As we work with our recruiters or do the recruiting ourselves, finding the right employees to fill open roles and adding staff to support our business goals is an essential function of what we do. Yet, sometimes the challenge rests not in our ability to chart the depths; rather, it is the fact that we can already see the bottom.

It may be of little consolation to those who remain out of work, but more people are viewing the U.S. labor market in a positive light. Consider, for example, the plight of “discouraged workers,” who are defined by the federal government as people not looking for work because they believe no jobs are available for them.

As an HR professional, I have certain expectations for candidates when they come in to interview for a job, regardless of what that position is.  When preparing to be on the opposite side of the table as an interviewee, I try to make sure I am my own best candidate.  It can be difficult, however, knowing that my expectations of candidates are not shared by all HR professionals.

Well, there are now fewer calls to the phone banks of plaintiffs’ lawyers’ as most problems resulting from holiday parties already have been raised.  But plaintiffs’ lawyers have no fear: there will be a salvo of calls after Valentine’s Day.  And that reminds me of a story.

It is 9:00 a.m.  A secretary reports to her desk.  Waiting for her is a sealed card.

The secretary opens the envelope and it is a Valentine's Day card from her manager.  Having undergone sensitivity training, the manager signs it "fondly" as opposed to "lovingly."

This isn’t ideal for young adults trying to get into rewarding careers, and ultimately it’s not good for business, either.
