A California appellate court recently confirmed that employees need not exhaust administrative remedies before pursuing most state Labor Code claims, even those accruing prior to the enactment of Labor Code Section 244(a), which expressly states there is no administrative exhaustion requirement. The decision brings clarity to an area of law noted for its split of authority.

The world has transformed since the turn of the twenty-first century, yet why are we recruiting the same way we did in the 90s?

I recently talked with my mom about getting some very rude service from a cashier at a local grocery store. Apparently, as she began putting her items on the belt, the cashier told her, “Get back! Get back!” My mom is very hard of hearing, so this confused her. By this time, the cashier was saying it in a very loud voice and other customers were looking.
You wouldn’t want to make the same egregious mistake as a Michigan employer. After the jump, I’ll discuss the colossal screw-up and help you avoid it.

HR will be called upon for creative retention strategies
It may be of little consolation to those who remain out of work, but more people are viewing the U.S. labor market in a positive light. Consider, for example, the plight of “discouraged workers,” who are defined by the federal government as people not looking for work because they believe no jobs are available for them.
As an HR professional, I have certain expectations for candidates when they come in to interview for a job, regardless of what that position is. When preparing to be on the opposite side of the table as an interviewee, I try to make sure I am my own best candidate. It can be difficult, however, knowing that my expectations of candidates are not shared by all HR professionals.
Well, there are now fewer calls to the phone banks of plaintiffs’ lawyers’ as most problems resulting from holiday parties already have been raised. But plaintiffs’ lawyers have no fear: there will be a salvo of calls after Valentine’s Day. And that reminds me of a story.
It is 9:00 a.m. A secretary reports to her desk. Waiting for her is a sealed card.
The secretary opens the envelope and it is a Valentine's Day card from her manager. Having undergone sensitivity training, the manager signs it "fondly" as opposed to "lovingly."
