With most laws, employers have less difficulty meeting the laws’ mandates as time goes by and they become more familiar with the requirements.

Not so with the Fair Labor Standards Act of 1938 (FLSA), where lawsuits have multiplied as the law has increasingly fallen out of step with the modern workplace, according to Paul DeCamp, an attorney in the Washington, D.C., area office of Jackson Lewis, and former administrator of the U.S. Department of Labor’s (DOL) Wage and Hour Division.

There are exceptions of course, but the vast majority of job descriptions –are cookie cutter templates that provide a laundry list of responsibilities and knowledge/skills/ability requirements that give a job seeker no sense of what it's like to work for the company. Traditional definitions of the word “innovation” tend to be just a bit too narrow and constrictive, according to HR consultant Susan R. Meisinger, SPHR.

Meisinger led the mega session “HR’s Role in Driving Innovation” on June 25, during the Society for Human Resource Management (SHRM) 2012 Annual Conference and Exposition, held here June 24-27. She told audience members that they needed to think of innovation as more than just generating new ideas, processes and products.

Employees with nonvisible disabilities often wonder whether to disclose their condition when applying for a job or working for an organization, because they fear negative repercussions will arise if they do so.

Yet people with disabilities are the largest and fastest growing minority group in the world, representing more than 750 million individuals, according to a recent webinar. In the U.S., there are more than 54 million people with disabilities. However, people with disabilities are employed at less than half the rate of their nondisabled counterparts.

Poorly run meetings start in the wrong place and end up rushed before they’re done.

Right place: Leave inconsequential items for the end. Deal with big items at the beginning. I’m tempted to check off a few quick agenda items before digging into the meat of meetings. It’s seductive but ineffective and inefficient.

Don’t prioritize insignificant agenda items by placing them first.

Aside: which major industry event will be the first one to actually adopt as its 'official' name the event hash tag? It would be kind of cool to see SHRM or some other organization to just drop the tired and formal sounding 'Conference and Exposition' part and just go with #SHRM12 as the event name.

The notion of business as a combination of sport and war was attributed to Emile Herzog (1885-1967), a French author who used the pen name, Andre Maurois. I’m going to admit at the outset that I was a strong proponent of Herzog’s concept for most of my career. However, now that I look back from the CEO afterlife, I realize that this view need not be pervasive.

Seventy-five percent of health care spending is attributable to illnesses that are behavior-related and preventable, which explains why employers increasingly are focused on starting health improvement programs. Unfortunately, an all-too-typical employee response when asked about their employer’s program is, “I think we have something, but not many people use it.” So said Brad Cooper, CEO of US Corporate Wellness, a provider of employee wellness programs, during his presentation at the 2012 SHRM Annual Conference, held here June 24-27.

The two-year omnibus highway transportation bill (H.R. 4348), passed by Congress on June 29, 2012, and signed into law by President Barack Obama on July 6, includes long-sought funding relief for employer-provided defined benefit pension plans. Roughly two-thirds to three-fourths of both buyers and sellers surveyed use retention agreements, chiefly for senior leaders below the boardroom level, key contributors and technical experts, according to the findings.

It’s not too late to train youth employed in summer jobs about workplace policies, something employers too often fail to do, according to Jay Zweig, an attorney with Bryan Cave in Phoenix. Training of youth and managers is particularly needed about sexual harassment, workplace safety and hourly restrictions.

Sexual Harassment

Sexual harassment is one of the biggest areas of complaint with all employees, Zweig noted. When youth haven’t been in the workplace before, they might not know how to behave appropriately with co-workers in that setting.

HR professionals may be familiar with the ins and outs of wage and hour laws, but managers often are not, Gregory Hare, an attorney at Ogletree Deakins in Atlanta, told attendees at a concurrent session on Monday.

Equally troubling is employees’ argument that they were unaware of an employer’s wage and hour policies. Don’t leave room for that argument—it could spell trouble in wage and hour litigation, he cautioned.

Hamlet is angry at his mother for marrying shortly after his father's death.  He sees her as weak.  He generalizes the weakness he sees in his mother to women generally.

No progressive manager would say a sexist comment like that today. Actually, they might, just when they think they are being progressive!
