I came across an article called The Rapid Rise of Robots Replacing Workers, written by Edwin Smith in Raconteur. Smith reports that in England a recent court decision has declared that Uber drivers are employees and not independent contractors. This is similar to many court decisions here in the United States. How does this play into the rise of robots replacing workers?

I know that many start-ups don’t consider human resources related laws when they are getting started. They focus on getting their product or service up and running, whether they have the suppliers they need and of course the potential market. If they consider HR at all it is in the realm of payroll. Most federal HR laws don’t kick in until a company has reached 15 employees. The FLSA kicks in at fewer employees if you are bringing revenue of at least a half million dollars. There are however other laws related to HR that you need to pay attention to, as Uber has discovered.

There is a great deal of controversy about the independent contractor and the gig economy. I have written about it a lot, as have many others. People are floating numerous ideas about how to utilize workers beyond the employee versus independent contractor. One such idea has been labeled as the dependent contractor.

I gave a presentation the other day, on behalf of ComplyRight on how companies can incorrectly classify workers as independent contractors rather than employees. Many companies think that using independent contractors is a prudent way of doing business. It reduces an employer’s liabilities, keeps costs down and provides greater flexibility than might be achieved by hiring an employee. It is indeed a great option AS LONG AS YOU DO IT CORRECTLY.
